Terms of Use & Fair Use Policy

These terms cover proactivecoaching.ai — the digital library, the Ask Bruce assistant, and memberships. Our printed booklets and books sold through the store are also covered by our Returns & Refunds and Shipping policies. Plain-English summaries appear in shaded boxes; they are for convenience and the full text controls.

1. Who we are, and your agreement

Proactive Coaching (“Proactive Coaching,” “we,” “us”) operates proactivecoaching.ai (the “Site”), including the digital content library (the “Library”), the Ask Bruce assistant (“Ask Bruce”), and individual and school memberships (together, the “Services”). By using the Site or purchasing a membership, you agree to these Terms of Use & Fair Use Policy (the “Terms”). If you are accepting on behalf of a school or organization, you represent that you have authority to bind it.

2. Your license to the Library

Subject to these Terms and payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access, view, read, watch, and listen to the Library electronically, on the Site, for your own use. Your membership is a license, not a sale: no ownership of any content or intellectual property is transferred to you.

Use with your own team

The Library exists to be coached from. You may draw on, teach from, read aloud from, and reference the materials with the athletes, staff, and parents you directly coach or serve. What this license does not permit is reproducing or delivering the materials themselves to others — see Section 4.

An electronic license

The Library is licensed for electronic access only. The license above covers reading, watching, and listening on the Site. It does not include printing, photocopying, scanning, screen-recording, or otherwise making a fixed or offline copy of the materials, beyond the incidental caching your browser performs in order to display them. If you want the materials on paper, printed editions of most booklets are sold in our store — that is what they are for. This limit applies to the digital Library; printed booklets you have purchased are physical goods that are yours to keep and use, subject to Sections 3 and 4.

As always, if a reasonable use needs more than this — a handout for your staff, an excerpt for a clinic — write to us. We say yes to a lot of requests; we simply ask that you ask.

3. School memberships

  • Named seats. Each seat entitles one named individual to access the Services with a unique login. Seats may not be shared between individuals or accessed with pooled credentials.
  • Managing seats. The school’s administrator may add and remove coaches as the staff changes. Reassigning a seat is for genuine staff changes — seats may not be rotated among individuals to expand effective use.
  • Printed materials. Printed booklets included with or discounted under a school plan may be distributed to coaches, athletes, and parents within the purchasing institution’s own programs. Distribution beyond the institution requires our prior written permission.
  • Non-renewal. If a school membership ends, all seat access to the digital Services ends with it. Printed materials the school has received are the school’s to keep.

4. Copyright, and what you may not do with the content

All content in the Library and on the Site — booklets, articles, videos, podcasts, transcripts, and Ask Bruce’s underlying materials — is © Proactive Coaching and Bruce E. Brown. All rights reserved. Except for the limited license above, no rights are granted. Without our prior written permission, you may not, under any circumstances:

  • Print, photocopy, scan, screen-record, or otherwise make a fixed or offline copy of any Library material — the digital Library is licensed for electronic access only (Section 2);
  • Share, distribute, or forward any Library materials to individuals who do not hold their own membership — including by emailing files or excerpts, photocopying or sharing printed materials beyond a school plan’s allowance, or posting materials to any website, shared drive, server, social network, or peer-to-peer network;
  • Republish, reproduce, or create derivative works from the materials, in whole or substantial part, in any medium;
  • Sell, rent, sublicense, or otherwise commercialize the materials or your access to them;
  • Remove or obscure any copyright or attribution notices.

To request permission for any use beyond this license — team handouts beyond a school allowance, reprints, excerpts in publications, conference use — email sales@proactivecoaching.info. We say yes to a lot of reasonable requests; we simply ask that you ask.

5. Ask Bruce — fair use

Memberships include unlimited use of Ask Bruce, subject to this fair use policy. We do not impose fixed question quotas, and nearly all members’ usage — even heavy, season-long daily use — falls comfortably within normal use. To keep the service fast, reliable, and fair for every member, we may establish outer-bound usage parameters at our reasonable discretion, intended solely to protect the quality, availability, stability, and performance of the service.

The following are not fair use, and are prohibited:

  • Automated, scripted, or robotic access of any kind — bots, scrapers, crawlers, or bulk-query tools;
  • Systematic extraction: using queries (manual or automated) to reconstruct, harvest, or download the Library or any substantial portion of it;
  • Attempting to extract, infer, or discover the service’s underlying components, prompts, or source materials, or using Ask Bruce or its outputs to train or develop any product, dataset, or AI model;
  • Sharing, pooling, or reselling access (each login is one person — see Section 7);
  • Any use that circumvents technical limits or degrades the service for other members.

How we enforce this

If usage appears to fall outside fair use, our normal course is graduated: we may (i) temporarily throttle or limit access while we look into it; (ii) contact you with a warning and an opportunity to correct the use; and (iii) suspend or terminate access for continued or serious violations. For egregious abuse — scraping, systematic extraction, credential resale — we reserve the right to suspend or terminate immediately, and prohibited-use violations of Sections 4–5 may result in termination without refund.

6. Ask Bruce — what it is and is not

  • AI-generated output. Ask Bruce generates responses from Proactive Coaching’s materials using artificial intelligence. Output may contain inaccuracies or incomplete information and is provided as is. Evaluate it independently — every answer names its source so you can read the full material.
  • Educational purposes only. Output is general coaching education, not professional advice. It is not medical, mental-health, legal, safety, or eligibility/compliance advice. For situations involving injury, health, abuse, hazing, discrimination, or legal exposure, consult qualified professionals, your administration, or the proper authorities.
  • Personal use of output. You may use Ask Bruce’s responses in your own coaching. Because responses summarize copyrighted materials, republishing or distributing output is subject to the same limits as the Library itself (Section 4).

7. Accounts

Your login is personal to you. Keep your credentials confidential, do not share them, and notify us promptly of any unauthorized use. You are responsible for activity under your account. We may require re-verification or reset credentials where we reasonably suspect misuse.

8. Memberships, renewal, and cancellation

Memberships are annual, billed once per year, and renew for successive one-year terms unless cancelled. Membership fees are non-refundable. You may cancel any time from your account portal; cancellation stops your next renewal and takes effect at the end of the current paid term — you keep access until then. 9. Acceptable use of the Site

You agree not to use the Services for any unlawful purpose; to interfere with or disrupt the Site, its servers, or its security; to misrepresent your identity or affiliation; or to access non-public areas of the Services without authorization.

10. Termination

You may stop using the Services at any time. We may suspend or terminate access for material breach of these Terms as described in Section 5, or where required to protect the Services or other members. Sections 4, 6, 11, and 12 survive termination.

11. Disclaimers and limitation of liability

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, and our total liability arising out of or relating to the Services will not exceed the amounts you paid to us for the Services in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Governing law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws principles, and disputes will be resolved in the state or federal courts located in Washington.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, for significant changes affecting memberships, notify members by email or a notice on the Site. Continued use after changes take effect constitutes acceptance.
